A recent court ruling in Spain has reignited debate over access to abortion services, after authorities in Madrid were ordered to create a registry of doctors who refuse to perform the procedure on conscientious grounds.

The decision follows a legal dispute between Spain’s Ministry of Health and the regional government of Madrid, which had resisted implementing the measure. The High Court of Justice of Madrid ruled that authorities must begin the process of establishing this registry without delay.

The registry stems from reforms introduced in 2023, requiring all regions in Spain to maintain a confidential list of healthcare professionals who opt out of providing abortion services. The goal is not to make this information public, but to help health systems ensure that enough non-objecting staff are available so women can access abortion care without unnecessary barriers.

This conflict highlights a broader issue across Europe: while abortion may be legal, access can still be limited in practice due to high numbers of conscientious objectors. In Spain, the majority of abortions are already performed in private clinics, and in some regions access within public healthcare remains limited.

Supporters of the registry argue that it is a practical tool to guarantee timely access to care. Critics, however, warn that such lists could infringe on doctors’ rights and create professional pressure.
